HMRC Guidance

Just showing an article from Rebecca Cave that she wrote on Accounting Web, I have not included the whole article only the conclusion

Conclusion

HMRCs manuals are not the law; the guidance they contain is merely guidance which can and will be ignored by the courts if it does not agree with the tax law. However, if you are relying on a section of HMRC guidance to defend a clients tax position, always print a dated copy of the page, as it can be changed without notice.

Check when the relevant section of the HMRC manual was last updated. All the recent updates should be listed on a separate page for each manual click on: See all updates in the header banner of the particular manual.

The gov.uk pages are even less reliable than the HMRC manuals. The guidance there has often been simplified to suit the gov.uk publishing guidelines so may miss vital points of detail.

If in doubt read the tax law, not the HMRC manuals.

I know, he's a traitor, lol.

Joanne has written similar warnings in threads as well.

By the way Doug, for important articles even on another website I've no objection to you including links.

I know that I don't get chance to post on here much at the moment (all the fun of life back in corporate) but you might notice that the spam keeps disappearing as I'm still here everyday skulking around in the background biggrin

Hope that business is booming matey,

Many many many times.

But good shout Doug, great to have this posted as a new post and one which perhaps can be linked to when someone needs the info.

Problem is - most folk who wander into the site these days do so not as CPD/read all the posts to learn stuff, but just when they actually want an answer to a specific Q - so many who need to see this probably wont. Cynic...moi.....nah!!!!
