Tax on income overseas


Hi all,

I have a client who was employee in UK for the last 6 years till December 2016 and in January 2017 moved to work on permanent employment contract in Cyprus.

His family - spouse and children under 18 are in UK and considered as UK residents.

I am right to say he does not need to declare this foreign income for the tax year 2016-17 on the basis income being from employment and all taxes paid at source?

Hi Nina

I would be careful with this one on two counts

1) Does your PII cover you for offering advice in an area you are not fully conversant?

2) You need to be careful with split year treatment. Usually the best way to prove non residency is by having no ties and no home in the UK (and a few other things). Its not necessarily the date he physically leaves the UK. There are tests.

Would recommend that you pass this on to a tax practitioner.
